INFORMATION FOR SELLERS / INTRODUCERS RE CONSIGNMENTS
BUYER is an Australian registered Company. We are Buyer Principals of AU Dore Bars and Nuggets. Our focus is on the small to medium sized mine, concession or Trading Company and our business model is predicated on FAIR TRADE and a financial return to a seller that we believe is the best available save for a direct Refinery Metals account.
Our standard discount rate is LBMA less 7.99%. ALL trials are directed to our contracted refinery in Germany. Sellers are welcome to travel with their consignments and will be welcomed by our local staff. Settlement transfers are issued wherever possible on the same day as receipt of the Refinery smelt and assay report. If that is not possible it will be the next banking day.
We wish to receive offers from small to medium sized mines/ concessions who are seeking to sell quantities normally from ten plus kilos monthly upwards. Our objective is to establish a good ongoing working relationship with our sellers and where appropriate see if assistance can be provided to increase their production in return for an appropriate offtake arrangement. If a Seller wishes to transact larger volumes then we ARE able to assist in the establishment of a direct Refinery Metals Account subject to agreement of terms OR utilise other Metals Accounts held by ourselves. We have zero interest in any proposal involving "Diplomatic Couriers" or demands for "Private Jets". Likewise we do not offer SBLC/MT 760 Instruments as such instruments are unsuited to this type of business unless prefunding a Production contract which is a facility that we do not offer.
Our format is as follows :
The Seller agrees a contract with us issued by our Head Office Legal Department in Melbourne.
- Seller provides all required information reference chain of supply KYC (Know Your Customer)/ Compliance where applicable. We then obtain Refinery approval for ALL new suppliers.Our FAST TRACK TRIAL PROTOCOL now requires minimal chain of supply compliance information/ documentation.
- Seller delivers the trial consignment direct to the Buyers Refinery in Germany via either Frankfurt or Leipzig airports. Please note that all consignments are consigned DIRECT to our German Government regulated Refinery.
- Please be aware that we expect to receive a copy of the MASTER AIRWAYBILL as soon as it is available. We have limited interest in "House Airwaybills" which have limited validity and have been much "abused"in the past.
- Upon arrival at the receiving airport a Refinery accredited Customs Clearing Agent clears the consignment through German Customs at either airport with all charges to the BUYER account.
- A German security company is instructed to provide armoured security transport from the airport to the identified Refinery as per contract. Cost to the BUYER account.
- The Refinery, upon arrival of the consignment, carry out preliminary testing to confirm that the consignment is as stated in the documentation. Cost to the BUYER account.
- The Refinery smelt and assay the consignment and provide a copy assay report to Buyer and Seller.This is normally completed within 24/ 48 hours of arrival. Cost to the BUYER account.
- Based on the Refinery assay report settlement is made through our Metals Account Trustee in Germany to the sellers nominated bank account as defined within the contract. Settlement on trial/ first consignments is normally based on a discount structure of London Bullion Market Association (LBMA) less 7.99% (seven point nine nine per cent). Settlement is normally completed within 24 hours of receipt of the Refinery report. Daily LBMA second fix/closing prices can be checked via www.lbma.org.uk (please see the opening page).
- Trial / first consignments are normally between five and twenty five kilos only at sellers option. Larger volumes are welcome on subsequent deliveries as per contractual agreement. Two kilo trials are being accepted during the Pandemic.
- Chain of supply KYC Compliance “clearance” is insisted upon by Refineries, Banks and many major Logistical Security Companies. However, assuming a consignment to be of non criminal origin and not involving child labour, then the process is very straightforward. We have expertise in the correct presentation from most AU producing countries including those historically regarded as problematical. For example re DRC specifically we have a situation where our Refinery will work constructively with us to achieve a positive outcome where there may be issues that need to be addressed. Please note carefully that on trial consignments of ten kilos or under there is minimal chain of supply compliance required. Further information upon request.
- We do NOT provide a financial instrument on trial / first consignments. This is due to the historically very high level of "drop outs/ non performance" by sellers even when a contract has been executed. We are no longer willing to block funds in relation to a financial instrument on any trial consignment. For this reason our CEO, a respected senior International Lawyer, has agreed and put in place this tried and tested procedure which offers total security to both Sellers and BUYER alike. This protocol will not be varied for a trial under any circumstances. Prefunding IS in principle available on trial consignments, through a Private Finance arrangement, subject to application and is normally limited to a contribution towards logistical costs.
- To "protect the integrity" of the arrangement it should be noted that at no time do BUYER have access to or handle the consignment. Our focus is to establish and promote long term business relationships with reliable suppliers. This protocol offers total security to both sides and is committed to in detail within all of our contracts.
- Financial Instruments ARE available on subsequent consignments based on a price / discount structure negotiated for individual proposals. Likewise we are open to considering pre funding of export charges where mutually agreed terms and procedures can be put in place. It is possible that such arrangements may involve a requirement for a second trial consignment to replicate procedures through the logistics company that sellers intend to use for ongoing deliveries. Prefunding of any sort will be available at commercially agreed rates.
- Whilst Sellers representatives are welcome to travel with their consignment it must be clearly understood that admission to the Refinery is at the discretion of the Refinery Management only. Any representative wishing to accompany a consignment should provide a certified copy passport plus certified local Police Clearance Certificate in good time for us to liase with the Refinery reference admission.
- In response to the, frequently, lengthy time taken to process visa applications we also suggest that if a Seller has a Europe based family member, friend or business associate who they feel can take their place at our German Refinery, if desired, then we shall be pleased to facilitate the necessary arrangements with the Refinery on the Sellers behalf. Otherwise we shall provide full assistance to the visa application process. We have in place already with many German Embassies in Africa formalised confirmations that our visa application support letters are acceptable without question as proof of "purpose of visit".
- It is the Sellers responsibility to ensure that any travelling representative has the necessary Business Visa for Germany plus any other relevant documentation to include healthcare insurance please. It is unwise to attempt to travel on a Tourist Visa with even a small hand carried consignment of AU as ALL metal MUST be declared at German Customs.
- We shall normally be able to arrange for a seller to be met at Frankfurt or Leipzig by our representative and driven to the Refinery - a journey of some two plus hours or one hour respectively. Additional information re travel/ hotels etc will be available after execution of contract.
- Reference commissions please be aware that any of our approved representatives involved in the introduction MUST be included in any commission arrangement.
We make a point of behaving in a professional manner throughout and hope to receive the same approach from those that we engage in business with. Our Trial protocol will not suit everyone and we respect the right of any seller to do business as they wish. We have an ever expanding customer base of sellers from numerous countries pleased to receive the enhanced financial return available. - Both Frankfurt and Leipzig Airports are operating normally in relation to high value cargo imports as is our Refinery.
- It is recommended that any seller wishing to travel should study the German Government website for the latest entry requirements in relation to the Pandemic.
"AU FAST TRACK TRIAL PROTOCOL"
TRIAL CONSIGNMENTS: 10 KILOS OR LESS
This facility is in place to enable sellers to engage with us with minimum formality and enable mutual comfort to be established.
Effective immediately the key points are:
* Applicable to any African country that is not subject to UN Sanctions . The Democratic Republic of Congo IS, in principle, acceptable.
* Ten kilos or less - minimum consignment two kilos. Applies to both Hand Carry and Freight Forwarder deliveries. ALL consignments are direct to our contracted German Government regulated refinery and are handled only by German
Customs and Refinery accredited staff.
* Minimal chain of supply documentation is required. Contract plus basic identification of seller plus consignment documents only. For Traders this means their own documentation only.
* Trial Consignments are normally processed within 24 hours of arrival at the
Refinery.
* Copy Refinery smelt and assay report to sellers. Settlement normally within one banking day.
* Our standard discount of LBMA less 7.99%
* All costs from receiving airport (normally Frankfurt or Leipzig) including Refinery accredited Customs Clearance, security handling and transport, testing and smelt and assay to buyer account
* We do not prefund on trials but are happy to look at doing so on subsequent deliveries subject to contract
